Possession of property stamp duty refund?
If you have merely paid stamp duty through Gras E challan or ESBTR certificate but have not registered related document for the same then possession of property does not come in question. However, if you have registered the document then the issue of possession becomes significant. Sometimes possession of property is granted on the same day and date on which you have registered the document whereas sometimes it is granted after number of months or years.
whether stamp duty should be granted to a stamp duty applicant is determined on the basis on whether a property sale transaction is complete. If a property purchaser receives possession of the said property then the transaction is said to be completed, in such a case the stamp duty is not refunded. Even if the said registered document is cancelled and the possession of the property is returned, refund of stamp duty is not approved.
